By accessing or using any of our services, products, and platforms—including our website, mobile applications, events, and content creation tools—you agree to be bound by these Terms. Introduction

TopCars, Inc. ("TopCars", "we", "our", or "us") provides a comprehensive automotive platform located at https://topcars.io, including all of its related subdomains, services, and mobile applications (the "Platform"). Through our Platform, users can access a variety of services including club management, event management, automotive content, vehicle transactions, and more (our "Services"). These Terms are a legal agreement between you and TopCars governing your access to and use of the Platform.

BY USING OUR PLATFORM, ACCESSING OUR SERVICES, OR PARTICIPATING IN ANY EVENTS, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE PLATFORM.

1. Accounts and Registration

To access certain features of the Platform, you may be required to create a user account (“Account”) by providing a valid email address, contact information, phone number and/or payment method. You are responsible for safeguarding your Account details, and you agree not to disclose your password to any third party.

By registering, you confirm that the information provided is accurate, complete, and up to date. You may not impersonate another individual or use an account without permission. If unauthorized activity is detected on your Account, notify us immediately at support@topcars.io.

2. Permitted Purpose

TopCars grants you a personal, limited, revocable, non-transferable, and non-exclusive right to access and use our Platform for personal use and the following purposes:

  • Accessing and scheduling automotive services such as car detailing and maintenance;
  • Registering for events including car shows, Cars & Coffee meetups, and workshops;
  • Creating and viewing automotive content;
  • Facilitating vehicle sales, purchases, and related services;
  • Registering and managing car clubs or organizations.

Any commercial use of our Platform beyond what is explicitly authorized by TopCars is strictly prohibited without prior written consent.

3. Prohibited Activities

In connection with your use of the Platform, you agree not to:

  • Use the Platform to impersonate any individual or entity;
  • Share your Account credentials with others;
  • Interfere with or disrupt the operation of our Platform or services;
  • Use automated tools (e.g., bots, scrapers) to access or download content from the Platform;
  • Use the Platform for any unlawful or unauthorized purposes, including but not limited to intellectual property infringement.

TopCars reserves the right to suspend or terminate access to any user found in violation of these restrictions.

4. Mobile Applications

If you download our mobile application (the "Mobile App") from third-party stores such as the Apple App Store or Google Play, your use of the Mobile App will also be subject to the respective App Store's terms and conditions. Ensure that you comply with those requirements, in addition to these Terms.

5. Pricing, Payment, and Subscriptions

5.1 Services and Pricing

TopCars offers a range of paid services, including but not limited to car detailing, vehicle sales facilitation, and event participation. Service pricing is subject to change and will be displayed at the time of booking or purchase.

5.2 Payments

Payment for all services must be made via a valid payment method provided by you at the time of booking or purchase. TopCars may apply applicable taxes and service fees. You agree to pay all fees associated with your chosen services.

5.3 Subscriptions and Membership

TopCars may offer subscription services that provide access to premium content or exclusive features (e.g., early event access, premium detailing packages). These subscriptions will automatically renew unless canceled.

6. Events and Appointments

TopCars hosts a variety of events, such as Cars & Coffee meetups, car shows, and other automotive gatherings (the “Events”). By registering for or attending an Event, you agree to abide by any Event-specific rules or policies. TopCars reserves the right to remove any attendee who fails to follow these guidelines.

For certain Events, TopCars may offer paid appointments or registration fees. Fees are non-refundable unless otherwise stated.

7. Third-Party Links and Services

The Platform may include links to third-party websites, content, or services. These third-party services are not under our control, and TopCars is not responsible for the accuracy, legality, or content of any third-party materials. Any dealings with third parties are solely between you and the third party.

8. Termination

We reserve the right to suspend or terminate your Account or access to our Platform at any time, without prior notice, for violations of these Terms or for any other reason.

9. Intellectual Property

All content, including text, images, video, and logos on our Platform, are the intellectual property of TopCars or its licensors. You may not use, reproduce, distribute, or create derivative works based on our content without express written permission from TopCars.

10. Dispute Resolution

If you have a dispute with TopCars, we encourage you to contact us first at support@topcars.io to resolve the issue. Any unresolved disputes will be handled through binding arbitration in accordance with the American Arbitration Association's rules. By using the Platform, you waive the right to participate in any class action or collective proceeding.

11. Limitation of Liability

TopCars will not be held liable for any direct, indirect, or consequential damages arising from your use of the Platform or services, including but not limited to loss of profit, data, or business opportunities. Our total liability will not exceed the fees you have paid to TopCars in the last 12 months.

12. Changes to the Terms

TopCars reserves the right to modify these Terms at any time. The most recent version of the Terms will always be available on our website. Continued use of the Platform after changes to the Terms constitutes your acceptance of the new Terms.
